Our Employment Litigation, Financial Services Regulatory and Hedge Funds Practices represented the former portfolio manager of a hedge fund in connection with an employment dispute. The dispute arose as a result of the collapse of the hedge fund following substantial losses incurred due to control failures.
Our employment and regulatory lawyers were retained to balance the competing needs to protect the client portfolio manager from liability arising both from claims of negligence and breach of contract and from breach of SFC regulatory requirements and to preserve salary and bonuses due to the employee. Our work included:
advising the portfolio manager on entitlements under the employment contract including possible claims for discretionary bonus
representing and advising the portfolio manager in connection with an SFC investigation in connection with the collapse of the hedge fund and in securing directors and officers liability insurance ("D&O Insurance") coverage for legal fees attendant to the investigation
advising the portfolio manager on the management of possible claims based on negligence, breach of contract.
