Our Dispute Resolution Practice and our Securities Broking and Dealing Practice represented the Hong Kong office of one of the largest stock brokers in Asia in connection with a client dispute. The client alleged a breach of the client account opening agreement and commenced arbitration proceedings administered by the Hong Kong International Arbitration Centre (“HKIAC”).

Our litigators represented the brokerage firm on all aspects of the dispute including:

  • advising on the merits of the claim and the possibility of mediation and settlement, including representing the client brokerage firm in settlement negotiations

  • conduct of pre-action communications

  • providing guidance on arbitral procedure including the Arbitration Ordinance and the [HKIAC Administered Arbitration Rules] and negotiating the procedures and timetable for the arbitration

  • reviewing and advising on the statement of claim and preparing the statement of defence in response

  • conducting discovery

  • preparing witness statements

  • coordinating with senior counsel

  • attending the arbitral hearing before the arbitrator
