Since the financial crisis in 2008, there have been increased calls for regulators around the world to hold individuals, rather than just firms, accountable for misconduct. In Hong Kong, the Securities and Futures Commission ("SFC") has officially declared that individual wrongdoer accountability is now an enforcement priority. The declaration has been accompanied over the past couple of years by increased direct enforcement action against directors of listed companies as well as responsible officers. With the introduction in December, 2016 of the Manager-in-Charge regime, it appears that the SFC is set to further increase focus on individuals, whether licensed or not, at licensed firms as well as the firms themselves as part of its disciplinary process.
