On December 27, 2024, the Securities and Futures Commission ("SFC") published a revised Business and Risk Management Questionnaire ("BRMQ") for licensed corporations ("LCs") and associated entities ("AEs") for the implementation of the RA13 regime. All LCs and AEs should use the revised BRMQ (see Annexes 1a and 1b) for financial years ending on or after 31 December 2024 and submit the BRMQ electronically to the SFC via WINGS.

Additionally, a Gazette notice (see Annex 2) was published specifying the form of the analysis of scheme assets for associated entities of an intermediary licensed or registered for Type 13 regulated activity. This form is available on the SFC website and should be used for financial years ending on or after 31 December 2024.

BRMQ is a supervisory tool the SFC uses to gather data and information to better understand the industry landscape, monitor market trends and identify emerging issues. Pursuant to Section 156("1")(a) and (b) of the Securities and Futures Ordinance (Cap. 571) as amplified by the Securities and Futures (Accounts and Audit) Rules, LCs and AEs are required to complete a BRMQ and submit to the SFC within four months after the end of each financial year.
