Proposed resolution under the Employees' Compensation Ordinance (section 48A of Cap. 282)

On September 24, 2025, LegCo approved a resolution to adopt the *Rules for the Adjustment of Medical Expenses Reimbursement Rates* under the *Employees' Compensation Ordinance ("ECO") and the Pneumoconiosis and Mesothelioma (Compensation) Ordinance ("PMCO")*.

The subsidiary legislation pertains to the adjustment of medical expenses reimbursement rates to align with new public healthcare service fees and charges. The proposals aim to update the rates to ensure that the compensation system remains fair and sustainable.

Specifically, the rates for in-patient treatment are increased from $300 to $300, for out-patient treatment from $300 to $500, and for in-patient and out-patient treatment on the same day from $370 to $700. These changes will take effect on 1 January 2026.

The proposal is supported by both the Labour Advisory Board and the LegCo Panel on Manpower, and it is anticipated to have minimal financial and staffing implications for the Government.

The amendments will provide positive benefits for families affected by work injuries or prescribed occupational diseases without altering the binding effect of the ECO and PMCO, or introducing significant economic, environmental, sustainability, or gender implications.
